Who Can Buy Property in India?

Under RBI's general permission, the following may freely purchase residential and commercial property in India:


  • Non-Resident Indian (NRI) – Indian citizen residing abroad holding a valid Indian passport.
  • Person of Indian Origin (PIO)– Holds/Held Indian passport, or parent/grandparent was an Indian citizen (excluding Pakistan, Bangladesh, China, etc.).
  • Overseas Citizen of India (OCI) – Citizen of another country but of Indian origin at or after constitution commencement.

Note: Agricultural land, plantation property, and farmhouses require specific RBI approval for all categories.

Payment Regulations (FEMA)

All NRI property purchases in India are governed by the Foreign Exchange Management Act (FEMA), 1999.


  • All payments for property purchases must be made through NRE, NRO, or FCNR (B) accounts maintained with authorized banks in India.
  • Foreign remittances through normal banking channels are permitted for eligible property transactions.
  • Direct payment in foreign currency or through traveller’s cheques is not permitted for property purchases in India.
  • Payments may also be made using funds received as gifts from eligible close relatives through approved banking channels, subject to applicable regulations.
  • Repatriation of sale proceeds is permitted in accordance with prevailing RBI and FEMA guidelines, subject to applicable conditions and tax clearances.

Note: Agricultural land, plantation property and farmhouses cannot generally be purchased by NRIs/OCIs under the general permission route. Separate FEMA/RBI regulations and limited exceptions (e.g., inheritance) may apply. Property acquisitions must comply with FEMA payment and banking requirements.

  • Payment for property acquisition may be made through:
    Inward remittance through normal banking channels; or Debit to NRE, NRO, or
    FCNR(B) accounts maintained with authorized dealer banks in India.

  • Payment through foreign currency notes, travelers' cheques, or other non-permitted modes is not allowed for property acquisitions in India.
  • Eligible buyers may avail housing finance from authorized banks and financial institutions in accordance with applicable regulations.
  • Repatriation of sale proceeds is permitted subject to FEMA provisions, RBI regulations, applicable conditions, and tax compliance requirements.

Eligibility & Definitions

Who qualifies as an NRI for property purchase?
An NRI (Non-Resident Indian) is an Indian citizen who resides abroad for employment, business, or vocation, or under circumstances indicating an intent to stay abroad for an uncertain duration. They hold a valid Indian passport and are recognized under the Foreign Exchange Regulation Act.


Can OCI/PIO cardholders also purchase property?
Yes. Both OCI (Overseas Citizens of India) and PIO (Person of Indian Origin) cardholders can purchase residential and commercial property in India under RBI’s general permission. They cannot, however, purchase agricultural land, plantation property, or farmhouses without specific RBI approval.


Can I buy property jointly with a resident Indian? 
Yes. An NRI can purchase property jointly with a resident Indian or another NRI. Joint purchase with a foreign national who is not of Indian origin is generally not permitted without specific RBI approval.


Is there a limit on the number of properties an NRI can buy?
There is no restriction on the number of residential or commercial properties an NRI can purchase in India. However, the acquisition of agricultural land remains subject to RBI approval regardless of quantity.


Can my family member manage the property on my behalf?
Absolutely. You can execute a Power of Attorney (POA) in favour of a trusted relative or representative in India. This person can manage all aspects of the property on your behalf, including signing documents and handling possession.

Through which accounts can NRIs make property payments?
Eligible NRIs and OCIs may pay for residential or commercial property through inward remittance via normal banking channels or from their NRE, NRO, or FCNR(B) accounts maintained with authorized banks in India. Payments through foreign currency notes or traveler’s cheques are not permitted.


What taxes apply when an NRI sells property in India?
Long-term capital gains (property held over 2 years) are taxed at 12.5% without indexation benefits. Short-term capital gains (property held less than 2 years) are taxed as per your income tax slab. TDS at applicable rates is deducted by the buyer at the time of payment. NRIs may benefit from DTAA provisions to avoid double taxation.


Can I repatriate the sale proceeds to my country of residence?
Yes. The Government of India allows repatriation of up to the original purchase amount or the sale proceeds, subject to applicable taxes and RBI guidelines. NRIs can repatriate up to USD 1 million of their sale proceeds after fulfilling tax obligations.


Is rental income from my Pune property taxable?
Yes, rental income earned from property in India is taxable under the Indian Income Tax Act, regardless of where you reside. However, you may be eligible for deductions on municipal taxes, mortgage interest, and a standard deduction of 30% on the net annual value.
